These Terms and Conditions apply to all participants (herein after referred to as the rider) using a hire bike provided by Thtenn. Completion of a hire acknowledges acceptance of these Terms and Conditions, Waiver and Release of Liability by the User.
I (the rider) have carefully read the agreement in its entirety and understand its content. I am aware this is an assumption of risk, waiver and release of liability and I agree to it voluntarily.
Undamaged condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes.
The rider is responsible for any negligent damage caused to the vehicle. Damaged parts or components will be repaired/replaced at the shop’s discretion and customer agrees to pay regular shop rates and retail prices for components replaced.
The rider authorises Thtenn to charge the rider’s payment card for all eventual costs in case of damage to the vehicle during the rental period, comprehensive of labour. In case of theft, the rider will be responsible for reimbursing Thtenn for the original price of the vehicle, plus the cost of any accessories that were provided at the time of the vehicle rental.
To hire Our vehicles and use Our services, You must be 17 years old or over. In case of multiple hire by one user, riders under the age of 16 must be accompanied by the account holder or by an adult who must be the Thtenn App account holder. Evidence of age may be requested.
In agreeing to these terms and conditions, waiver and release, the rider (“You”, “Your”) confirms they understand the inherent risk involved in using Our Vehicle hire services and accept full responsibility for any and all damages or injuries which may result in severe injury, including but not limited to spinal or head injury.
In consideration of Thtenn renting this vehicle to the rider, the rider specifically releases and forever discharges Thtenn and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which the rider may suffer while using Our vehicle hire services.
This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence “Thtenn”, “We” or its affiliates, officers, agents, or employees.
The rider(“You”) confirms it is Your intent by the Waiver and Release Agreement to release Thtenn and hold it harmless from all liability for any property loss or damage, personal injury or loss of life caused by Your negligence or whether based upon breach of contract, or any other legal theory.
The rider fully realises that if injury, illness, death or damage occurs to the rider or there their child while they use thtenn hire services or cycling, they will have no right to make a claim or file a lawsuit against Thtenn or its affiliates, officers, agents or employees, even if the rider or any of their network of friends and associates negligently cause the rider’s (or child’s) injury, illness, death or damage.
By confirming for a minor, the rider agrees that they are their parent or legal guardian and releasing Thtenn from any claims, lawsuits or responsibilities for that minor. Each of the riders has read this agreement for use of bikes and release and waiver of liability.
Company/Seller shall mean Thtenn LTD, trading as Thtenn, registered in England and Wales under company number 16201289.

The company reserves the right to amend technical or clerical errors in any order without notice. In addition, the user shall ensure that all details and documents required to use Our services are correct and up to date and no liability for any error or inaccuracy shall lie with the company.
The company reserved the right to amend or cancel any service rendered. Examples of when this might be applied include if We believe the transaction to be fraudulent or if there has been an error in the pricing or availability of Our services. We will notify customers of any such cancellations and issue a full refund where applicable.
Website and App based prices are given on the assumption that no variation in the price will be made by the behaviour of the service user or incidents that may cause extra charges and that Government levies remain unaltered. In the event of such changes, orders placed before the variation will remain the same price and no further increases will be passed to customer.
We try to ensure that all pricing information on the Website and the App are correct. Occasionally, however, an error may occur and services may be mispriced. If a service correct price is lower than the price stated on the Website or App, we will charge the lower amount and render services as usual. If a service correct price is higher than the price stated on the Website and the App, we will, at our discretion, contact you and ask you whether you wish to proceed with the correct price or cancel the service and notify you of such cancellation. We will not be obliged to render services at an incorrect price.
All guarantees for services are provided entirely by Thtenn and are subject to agreement, terms and conditions contained therein. Users are reminded to complete the required questions and upload all documents where appropriate.
Advice given by Thtenn Team or during telephone calls or live chat is based entirely upon information given by Thtenn. Where advice is given after visual inspection by user, such advice shall amount to an opinion only and the company shall not accept liability for any inaccuracies. Additionally, Services rendered are done only to correspond with the purpose for services commonly rendered and not alternative uses to which they may be put. No liability for failure can be accepted by thtenn for such alternative use, amendment or modification.
Compatibility of services we render is not guaranteed where modifications or alterations have been made by the user and the company shall, in such circumstances, and at its discretion, issue a refund or credit to the user.
Where vehicles are alleged to be defective or faulty, the user agrees to return the vehicle to its location for Our inspection and report the faults and why they returned the vehicle without use. The user further confirms that they shall be reasonable for Thtenn to inspect, repair or replace (at its option) such defective or faulty vehicle and allow manufacturers to undertake inspections so as to allow vehicle upgrade. The user also accepts that it is reasonable to inform Thtenn of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow Thtenn to remedy the defect, failure or interruption. upgrade or adapt the vehicle.
Vehicles are made available for use and are subject to wear and stress whilst in use. Life expectancy and durability are greatly reduced and users should note that any claim for failure/wear shall be limited. It is agreed that such use shall be a relevant circumstance.
Where maintenance to vehicles have been made, the company shall accept no liability for death or personal injury unless caused directly by its own negligence.
No liability is accepted by thtenn where user attempt to modify or use vehicle where it is unknown or authorised as this is a breach of contract and not in accordance with agreement, terms and condition.
The company accepts no liability in respect of failure of service or other interruptions caused by matters beyond the reasonable control of Thtenn, including strikes, lockouts, civil disputes, acts of God, war, website pricing or stock availability errors or actions by third parties.
If you wish to make a change to an order or cancel it then it is important to note that our turn-around time on messages is 3 working days. There is a chance therefore that your request may not be picked up in time. This agreement shall be interpreted in accordance with English Law and industry custom and practice, and English courts shall have sole jurisdiction in respect of any dispute arising there from. In respect of App services, jurisdiction or the agreement shall be with English Law.
